It is possible to get a reasonably fast inexpensive divorce provided both parties are in agreement and stay in agreement. What I mean, is if both spouses, after full disclosure of all financial assets and liabilities, agree to the division of assets and liabilities, including real property and retirement plans, and, if they have children, agree as to the parenting plan and are aware and agree to the proscribed child support, then, yes, a divorce can be relatively simple and inexpensive. The key both parties have to be in complete agreement. The way I handle these situations is I represent one of the spouses. Once retained, we serve the other spouse. We still need to follow of the procedural steps to concerning the filing, including the financial disclosures. Once those procedures are completed, I will prepare the settlement agreement, which my client reviews and we then forward to the spouse for their opportunity review the agreement and also bring it to an attorney for review as well. The Settlement Agreement is executed independently by both parties and filed with the court. The case goes before the Judge for the final hearing and subject to the court's review and approval the Divorce is granted.
